Terms and Conditions

Welcome to Capital Mabati. These Terms and Conditions apply when you use capitalmabati.co.ke, request a quotation, or buy roofing sheets and building materials from us online, by phone, on WhatsApp or at any of our branches. Please read them before placing an order.

1. About these terms

These Terms and Conditions form an agreement between Capital Mabati Limited, whose head office is on Eastern Bypass, Nairobi, and every customer, whether an individual or a business, who buys from us or uses our website.

By placing an order or using our website, you agree to these terms. Nothing in these terms limits any rights you have as a consumer under the Consumer Protection Act, 2012 or other laws of Kenya.

2. Using our website

• You agree to use our website only for lawful purposes and to give accurate details when you request a quote or place an order.
• We work to keep the website available and accurate, but we do not guarantee it will always be available or free of errors.
• Our website links to other sites, such as social media and WhatsApp. We are not responsible for their content or practices.

3. Products and descriptions

• We describe our products, including profiles, gauges, lengths, finishes and sizes, as accurately as we can.
• Colours and finishes may look slightly different on screen than in real life. You are welcome to view samples at our Kamakis showroom or head office before buying.
• Product images are for illustration. Minor variations in natural materials, such as the grain and colour of timber, are normal.
• All products are subject to availability. If an item you ordered is out of stock, we will contact you to offer an alternative, a later delivery date or a refund for that item.

4. Prices and quotations

• All prices are in Kenya Shillings (KSh). Prices on our website can change without notice, but the price confirmed for your order will not change once we have accepted it.
• Quotations are based on the information you give us, such as measurements, quantities and delivery location. If that information changes, the quotation may change too.
• A quotation is valid for the period stated on it. If no period is stated, it is valid for 7 days.
• If a price on our website is clearly wrong because of an obvious error, we will tell you before accepting your order and you can choose whether to continue.

5. Placing an order

• You can order through our website, by phone, on WhatsApp, by email or at our branches.
• Your order is accepted when we confirm it to you by phone, message, email or receipt.
• Please check the quantities, lengths, gauges and colours carefully before confirming. Sheets cut to the lengths you request are made specifically for your order.
• We may decline an order, for example if a product is unavailable, an address is outside our delivery reach, or we suspect fraud. If you have already paid, we will refund you in full.

6. Payment

• Our team will confirm the total amount and payment details when your order is confirmed. Orders are processed once payment is received, unless we agree otherwise in writing.
• Only pay using the official Capital Mabati payment details given to you by our staff. If anyone gives you different payment details, call us on +254 711 082 333 before paying. We are not responsible for payments made to anyone else.
• We will issue a receipt or invoice for every payment.

7. Delivery

• We deliver across Kenya. Delivery usually takes 3 to 7 working days from order confirmation, depending on your location. These times are estimates, and we will keep you informed of any delay.
• Orders of more than 30 mabati pieces are delivered to your site. Smaller orders are delivered to the nearest town for collection.
• For site deliveries, please make sure the site is accessible to our delivery vehicle and that someone is available to receive and offload the goods. If our vehicle cannot reach your site safely, we will deliver to the nearest accessible point.
• If no one is available to receive the delivery at the agreed time, we may need to arrange a new delivery date.
• Responsibility for the goods passes to you once they are delivered and received.

8. Collection from our branches

You can collect your order from our Eastern Bypass head office, Kamakis showroom or Kitui branch. Please bring your order confirmation or receipt. Responsibility for the goods passes to you once they are collected.

9. Checking your order

• Please check your goods when they are delivered or collected, and confirm that the quantities, sizes and condition match your order.
• If anything is missing, damaged or incorrect, tell the driver or our staff at the time, and contact us within 48 hours with your order details and photos where possible.
• We will replace missing, damaged or incorrect items, or refund you for them.

10. Returns and refunds

• We offer hassle-free returns. To return an item, contact us within 7 days of delivery or collection with your order details and the reason for the return.
• Returned items must be unused, undamaged and in a resaleable condition.
• Items cut to custom lengths, mixed paint, and items damaged by improper handling, storage or installation after delivery cannot be returned unless they are faulty.
• Faulty or incorrect items will be replaced or refunded in full. Approved refunds are paid using the original payment method, or another method we agree with you.

11. Quality guarantee

We stand behind the quality of our roofing products and building materials. If a product is faulty, contact us with your order details and photos and we will inspect it and, where the fault is confirmed, repair, replace or refund it. Our guarantee does not cover damage caused by improper installation, incorrect storage, misuse, accidents, or normal wear over time. Where a manufacturer provides its own warranty, we will help you make a claim under it.

12. Technical advice and installation

We are happy to advise on products and to estimate quantities from your plans or measurements. This advice is given in good faith based on the information you provide. Final measurements, structural design and installation are the responsibility of you and your contractor or fundi. We recommend that roofing and structural work is carried out by qualified people.

13. Limitation of liability

• We are responsible for losses you suffer that are a foreseeable result of us breaking these terms.
• We are not responsible for indirect losses, such as loss of profit, business or time, or for delays caused by events outside our reasonable control, including bad weather, road conditions, strikes or supplier shortages.
• Where the law allows, our total liability for any order is limited to the price you paid for that order.
• Nothing in these terms limits our liability where it would be unlawful to do so.

14. Intellectual property

The Capital Mabati name, logo, website content, product photos and text belong to Capital Mabati Limited or are used with permission. You may not copy or use them for commercial purposes without our written consent.

15. Privacy

We handle your personal data in line with the Data Protection Act, 2019. Please read our Privacy Policy to see how we collect, use and protect your information.

16. Changes to these terms

We may update these terms from time to time. The latest version will always be on this page with the date at the top. The terms that apply to your order are the ones in force when we accepted it.

17. Governing law and disputes

These terms are governed by the laws of Kenya. If you have a concern, please contact us first so we can try to resolve it quickly. Any dispute that cannot be resolved between us will be handled by the courts of Kenya.
